By accessing and using the services provided by Blackhurst Aviation, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.
Services and Quotes
All quotes provided by Blackhurst Aviation are valid for 30 days from the date of issuance unless otherwise specified. Prices quoted are estimates based on the information available at the time of assessment. Final pricing may vary based on additional findings during project execution.
A deposit may be required before work begins on your aircraft. Deposit amounts and refund policies will be communicated clearly before work commences.
Service Agreements
Before any work begins, we will provide a detailed service agreement outlining the scope of work, estimated completion date, and total cost. By signing this agreement, you authorize us to proceed with the specified services.
Any changes to the scope of work must be approved by both parties in writing before proceeding. Additional charges may apply for work outside the original scope.
Payment Terms
Payment is due upon completion of work unless other arrangements have been made in writing. We accept various payment methods including cash, check, and major credit cards. For large projects, payment schedules may be established in the service agreement.
Aircraft Care and Liability
While your aircraft is in our care, we maintain comprehensive insurance coverage. In the unlikely event of damage caused directly by our negligence, our liability is limited to the cost of repair or replacement as covered by our insurance policy.
We are not responsible for pre-existing conditions, wear and tear, or damage caused by factors beyond our control including but not limited to weather, Acts of God, or defects in materials or manufacture.
Warranty
Blackhurst Aviation warrants its workmanship for a period specified in your service agreement. This warranty covers defects in our workmanship but does not cover damage resulting from misuse, accidents, normal wear, or lack of proper maintenance after the work is completed.
Warranty claims must be submitted in writing and will be evaluated on a case-by-case basis.
Intellectual Property
Any custom designs, paint schemes, or specifications created by Blackhurst Aviation remain our intellectual property unless otherwise agreed in writing. We reserve the right to use photographs of completed work for promotional purposes unless you specifically request otherwise.
Limitation of Liability
To the maximum extent permitted by law, Blackhurst Aviation shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from or related to our services.
Force Majeure
We shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, or labor disputes.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Minnesota. Any disputes arising from these terms or our services shall be resolved in the appropriate courts of Minnesota.
Changes to Terms
Blackhurst Aviation reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of any revised terms.
